Morsel Games Privacy Policy - v1.0

From time to time, the nature of our business dictates that we may collect personal information from our customers. Because we are committed to protecting your privacy rights and the information you provide to us, we have developed this Privacy Policy (“Privacy Policy”). This Privacy Policy sets forth how Whyle Labs Inc. (“Morsel Games”) collects, protects and uses the personal data of our customers.

1. COLLECTION AND USE OF DATA

  • 1.1 Personal data we collect: Our primary reason for collecting data is to provide products and services to our customers. To this end, we collect data when you:
    1. Contact us;
    2. Request information about our products and services;
    3. Create an account and play our games;
    4. Purchase virtual items, in-game currency, or other digital goods;
    5. Respond to surveys;
    6. Access our website;
    7. Use our application (web application, on-device application);
  • 1.2 Data we collect: We collect the following data from you:
    1. Names/emails/other contact information you choose to provide (e.g. for account recovery, mailing list signup, or support requests);
    2. Account and gameplay data, including your in-game actions, session results, statistics, achievements, and rankings;
    3. Purchase data, including records of virtual items, in-game currency, and other digital goods you buy, and the billing information needed to process the transaction (see Section 5);
    4. Application and product use data, including device, browser, operating system, and similar technical information; your general network location (IP block), which we may use more generally, such as to improve our products and services; and your full IP address, which we use solely for security, fraud-prevention, and abuse purposes;
    5. Location information you provide (e.g. province, state, or country), which we use for regional statistics;
  • 1.3 How we use the data we collect: We use the data we collect for the following:
    1. Fulfil contractual requirements, including processing and delivering purchases;
    2. Operate and improve our products and services, including matchmaking, leaderboards, rankings, and game balancing;
    3. Display certain gameplay data to other players, as described in Section 3;
    4. Train, test, and improve artificial intelligence and machine learning models and systems, as described in Section 4;
    5. Communicate information about Whyle Labs Inc. to potential customers, customers, potential partners and partners (including payment processors and financial institutions for processing payments);
    6. Generate aggregate statistics by region (e.g. by province, state, or country);
  • 1.4 Why we need the data we collect: We need the data we collect to:
    1. Provide services to you, including delivering virtual items and in-game currency you purchase;
    2. Provide notifications, surveys, and product updates;
    3. Obtain customer feedback, respond to product inquiries, report/resolve support incidents;
    4. Communicate information about Whyle Labs Inc. to potential customers, customers, potential partners and partners;
    5. Improve our products, including through the display of gameplay data to other players and the training of AI/ML systems described in Sections 3 and 4;
    6. Understand and report on regional usage of our products and services;
  • 1.5 Storage location of the data we collect: All data we collect is processed, hosted, and/or stored on systems operated by Whyle Labs, trusted cloud providers, third-party service providers, or on your device.
  • 1.6 How long we store the data we collect: We retain your personal data until you request for us to delete the same and/or as required by law and/or after prolonged account inactivity. Data deletion requests will take some time to process, and may have limits on what is deleted.

2. TRACKING WHILE NOT LOGGED IN

  • 2.1 Purpose: In addition to security and debugging, we track users even before logging-in or account creation in order to improve the product and to improve marketing.
  • 2.2 Method: Tracking is done using technologies like cookies.
  • 2.3 Not-individually identifiable: Before account creation, we design our analytics systems to minimize the collection of information that directly identifies individuals. Where reasonably practicable, we use aggregated or pseudonymous identifiers until an account is created (excluding security and debugging).
  • 2.4 Linking after logging in: While data collected before accepting the EULA and privacy policy are not intended to be individually identifiable, we may link previously collected information to an individual once they have created an account or logged in.

3. VISIBILITY OF YOUR DATA TO OTHER PLAYERS

  • 3.1 Purpose: Morsel Games is a multiplayer platform. As part of providing our services, we display certain gameplay data to other players, such as leaderboards, rankings, gameplay, match or session results, statistics, and achievements.
  • 3.2 Scope: Where we allow you to set a username or display name, that name may be shown alongside your gameplay data to other players and, in some cases, publicly. Where no username is set, gameplay data may still be shown in an anonymized or pseudonymous form (e.g. by rank or session ID).
  • 3.3 Control: Where we provide settings to control the visibility of your profile or gameplay data, you may use them to adjust what other players can see.

4. USE OF DATA TO TRAIN AI AND MACHINE LEARNING SYSTEMS

  • 4.1 Purpose: We may use gameplay data, account data, and other usage data described in Section 1 to train, test, and improve artificial intelligence and machine learning models and systems. This includes, for example, models used to power in-game features (such as AI opponents, matchmaking, and recommendations), improve anti-cheat and fraud detection, and improve our products and services generally.
  • 4.2 De-identification: Where reasonably practicable, we aim to use aggregated or de-identified data for these purposes. However, some AI/ML training and evaluation may be performed using personal data as described in Section 1.

5. PAYMENT PROCESSING AND PURCHASES

  • 5.1 Payment processing: Purchases of virtual items, in-game currency, and other digital goods made through our services may be processed by us directly, by our third-party payment processor(s) on our behalf, or through a third-party platform, depending on how you access our services. Receipts, refunds, and billing disputes are handled by whichever party processed the purchase.
  • 5.2 Payment information: Any billing or payment card information you provide is collected and processed by the applicable payment processor. We do not intentionally store full payment card numbers on our own systems.

6. THIRD-PARTY ADVERTISERS

  • 6.1 Sharing with third-party advertisers: We do not use third-party tracking pixels and similar services. The only information we share with advertising partners that could potentially be associated with an individual is conversions (e.g. this user signed up for a trial) using the advertiser-provided ID (e.g. a click ID). This is only for users that came to us from that advertiser and after being presented with an opt-out. We do not share additional personally-identifying information (e.g. email addresses).

7. YOUR RIGHTS AND CONTROL OVER YOUR DATA

  • 7.1 Control: Should you believe that any personal data we hold on you is incorrect or incomplete, you can request to see this information, rectify it or have it deleted.
  • 7.2 Additional rights: Depending on where you live, you may have additional statutory rights over your personal data (for example, under PIPEDA, GDPR, or CCPA/CPRA). Contact us to exercise any of these rights and we will respond as required by applicable law.

8. CHILDREN'S PRIVACY

  • 8.1 Age restriction: Our services are not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe a child under 13 has provided us with personal information, please contact us so that we can investigate and, where appropriate, delete that information.

9. DATA BREACH PRACTICES

  • 9.1 Incidents of breach: When Whyle Labs Inc. learns of a suspected or actual personal data breach, we perform an internal investigation and take appropriate remedial measures in a timely manner. Where required by applicable law, we will notify affected individuals and relevant authorities within the time required by applicable law.
